Federal Air does not guarantee connections.
Each day is different and every flight is planned to ensure that passengers are transported to their destinations with the least amount of flying possible. This constant variation, together with factors beyond our control (Weather and Air Traffic Control) makes Federal Air a logistically complex air charter operation.
Your patience and understanding in agreeing to flexible departure and arrival times is greatly appreciated.
As you read these conditions, please note that:
“we”, “our”, ourselves” and “us” means FEDERAL AIR (PTY) LTD with its centres of business situated at Virginia Airport, Durban, Johannesburg International Airport, and Kruger Mpumalanga International Airport, Nelspruit.
“you”, “your” and “yourself” means any person, except members of the crew, carried or to be carried in an aircraft, having a ticket valid for the transportation.
- The contract of carriage is made between you and us.
- Warsaw Convention means the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw, 12 October 1929, or the Convention as amended at The Hague, 28th September 1955, or the Convention as amended in Montreal, whichever may be applicable.
- If your journey involves an ultimate destination or stop in a country other than the country of departure, the Warsaw Convention and/or Montreal Convention (“the Convention”) may be applicable. The Convention governs, and in most cases limits, our liability for death or personal injury and in respect of loss of or damage to baggage.
- Baggage
- You are permitted one (1) standard piece of hand baggage (max 5 kg) and one piece of standard checked-in hold baggage (max 20 kg).
- For excess baggage each additional kilogram may be charged for at our standard rate subject to space and/or weight availability.
- In addition, you may carry on board a handbag, clutch bag, coats umbrellas, laptop computers and small items of camera equipment.
- Checked bagged will be delivered to bearer of the baggage check.
- In case of loss, delay and /or damage to baggage, a complaint must be made in writing to the carrier within seven (7) days of loss occurring.
- Liability for loss, delay and /or damage to baggage is limited to US$20.00 per kilogram – Maximum of US$400.00 per person.
- The carrier accepts no liability for loss, delay and/or damage to excess baggage if such baggage is carried “free of charge”.
- If you have fragile, valuable and/or perishable articles included in your baggage we recommend additional insurance from your personal insurer, as these articles are limited as mentioned above. If you have any questions regarding baggage, please consult with us prior to boarding.
- In all cases in which the carriage is not governed by the said Convention, carriage is only accepted at the passengers’ risk and upon the specific condition that the Carrier(s), their servants and agents shall be under no liability for any damage on any kind whether caused or occasioned during carriage by air or in condition with auxiliary services incidental to the damage by air or whether or not caused or occasioned by the act, omission or default of the Carrier(s), their servants or agents. The passenger hereby indemnifies the Carrier(s) against any claims for compensation for any damage, loss or injury whether sustained on board the aircraft or in the course of any of the operation of flight embarking or disembarking caused directly or indirectly to him or his belongings, which indemnity shall extend to the passenger’s dependents, estate or any person whomsoever.
- Federal Air (PTY) Ltd is a point-to-point carrier.
- Although we undertake to use our best efforts to carry you and your baggage with reasonable dispatch times shown on the ticket, in timetables or elsewhere are not guaranteed and form no part of this contract. Carrier may without notice substitute alternate carriers or aircraft, and may alter or omit stopping places shown on the ticket in case of necessity. Schedules are subject to change without notice.
- The Carrier will not be held responsible for missed connections and is not liable for any claims in respect of passengers missing an onward flight as a result of their first flight being delayed.
- If flights are cancelled and no suitable alternative flight is available, we will, upon application, fully refund all monies paid in respect of the cancelled flight, on application, without further liability. The Carrier does not provide meal vouchers or hotel accommodation at any time.
- If it is the opinion of The Carrier that a passenger will not safely and/or comfortably fit in one of the aircraft seats, The Carrier Personnel reserve the right to allocate an additional seat or an upgrade to another class at the passengers cost. Should no seat or Class upgrade be available, The Carrier will book the customer on the next available flight.
- Carrier undertakes to use its best efforts to carry the passenger and baggage with reasonable dispatch; but times shown on the ticket, in timetables or elsewhere are not guaranteed and form no part of this contract. Carrier assumes no responsibility for making connections.
- With respect to delays, The Carrier shall be under no liability except as provided in these Conditions, subject to applicable laws and the Convention if applicable.
- Aircraft and departure times are subject to change without notice.
- Please bring proof of identity to the airport for the purpose of check-in.
- The following dangerous goods are not permitted in baggage:
- FLAMMABLE LIQUIDS AND SOLIDS such as lighter or heater fuels, paint and matches. RADIOACTIVE MATERIAL, OXIDIZING MATERIALS AND ORGANIC PEROXIDES such as bleaches and fibreglass repair kits.
- FIREARMS AND EXPLOSIVES Handguns, automatic weapons, munitions, ammunitions including blank cartridges, pistol caps, fireworks, flares, smoke canisters and crackers. Note: As an exception, sporting/competition firearms and a maximum of five (5) kg of ammunition may be carried in the aircraft/s luggage hold/s if declared at check-in and properly packaged.
- INFECTIOUS SUBSTANCES such as bacteria and viruses.
- CORROSIVES such as mercury, acids, alkalis and wet-cell batteries
- COMPRESSED GASES. Deeply refrigerated flammable,, non-flammable and poisonous gases such as butane, oxygen, propane and aqualung cylinders.
- Expectant mothers may travel up to and including the 27th week of their pregnancy, and will be accepted between the 28th and 34th week on their return flight, if they are in possession of a doctor’s certificate confirming the stage of their pregnancy and that they are fit to fly.
- The carriage of live animals, including pets, insects, reptiles or any other form of livestock is forbidden under any circumstances, with the exception of guide dogs for blind and/or deaf passenger on domestic flights only.
- We do not accept human remains for carriage on any routes. However, the carriage of ashes is permitted provided a copy of the death certificate and the cremation certificate accompanies them. You must ensure the ashes are securely package in an appropriate container and should be included in your hand luggage.
- You will only be accepted for travel if you are in possession of the correct documentation required for entry into your destination country. It is your responsibility to obtain and present this. You are responsible for all additional costs relating to incorrect documentation including, but not limited to deportation.
- Passengers who are disruptive, or who are under the influence of alcohol or drugs, and are deemed unfit for travel may be prevented from boarding a flight and/or they may be removed from an aircraft and banned from the airline on a temporary or permanent basis. It is company policy to support the police and flight crew fully in any investigation into an incident on any of our aircraft.
- We are not liable for damage arising form our compliance with, or your failure to comply with, applicable laws or Government rules and regulations.
- The contract of carriage, including these conditions of carriage and exclusions or limits of liability, applies to our authorized agents, servants, employees and representatives to the same extent as they apply to us. The total amount recoverable from us and from such authorized agents, employees, representatives and persons shall not exceed the amount of our own liability, if any.
- Nothing in these conditions of carriage shall waive any exclusion or limitation of our liability under the Convention or applicable laws unless otherwise expressly stated.
- Nothing within these conditions of carriage shall waive any exclusion limitation of our liability or any defence available to us under the Convention or applicable laws against any public social insurance body or any person who is liable to pay compensation or as paid compensation in respect of the death or bodily injury of a passenger.
- Any costs that may be incurred as a result of having to divert to an alternate aerodrome, due to weather or any other reason beyond our control, which may affect the safety of our passenger , aircraft or crew will be for your account.
- Any action against the Carrier(s) shall be brought only in the Court of the State or territory in which the principle of business of the Carrier(s) is situated.
- “Federal Air’s Daily Shuttle Service is not a scheduled service. Our departure times are not fixed, and are for notational purposes only.”
DISCLAIMER
Whilst every effort is made to ensure that all information is updated and correct the Carrier(s) and/or its servants and agents shall not be liable for any loss, breach, damage (whether direct, consequential, general or special) or expense of any nature whatsoever which may be caused, directly or indirectly through the use of, supply or reliance upon any information or service provided by or to the public, airline or any other body through this document.
